Terms of Service

1. Acceptance of Terms

By accessing or using the BEAST platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

BEAST is a WhatsApp automation platform that provides businesses with tools to create chatbots, send bulk campaigns, manage customer conversations, and leverage AI-powered responses through the WhatsApp Business API. The Service includes a web-based dashboard, API integrations, analytics, and customer relationship management features.

3. Account Registration

To use the Service, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access to your account
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Acceptable Use Policy

When using our Service, you agree NOT to:

• Send spam, unsolicited messages, or bulk messages without proper consent
• Violate any applicable laws, regulations, or WhatsApp Business policies
• Transmit harmful, abusive, threatening, or illegal content
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Use the Service to collect personal data without proper authorization
• Interfere with or disrupt the integrity or performance of the Service
• Impersonate any person or entity, or misrepresent your affiliation
• Use automated scripts or bots to access the Service without authorization
• Resell, sublicense, or redistribute the Service without written consent

Violation of this policy may result in immediate account suspension or termination without refund.

5. WhatsApp Business API Compliance

As a user of our platform, you must comply with Meta's WhatsApp Business Policy and WhatsApp Commerce Policy at all times. This includes but is not limited to:

• Obtaining opt-in consent before messaging customers
• Using approved message templates for business-initiated conversations
• Respecting customer opt-out requests promptly
• Not sending prohibited content categories as defined by Meta
• Maintaining a high-quality rating for your WhatsApp Business Account

BEAST is not responsible for any actions taken by Meta against your WhatsApp Business Account due to policy violations.

6. Payment and Billing

Certain features of the Service require a paid subscription. By subscribing to a paid plan, you agree to the following:

• All fees are quoted in Indian Rupees (INR) unless stated otherwise
• Subscription fees are billed in advance on a monthly or annual basis
• You authorize us to charge your selected payment method automatically
• Prices may change with 30 days' prior notice
• Applicable taxes (GST) will be added to your subscription amount
• Failed payment attempts may result in service suspension

7. Refund Policy

Refunds may be issued at our sole discretion under the following conditions:

• Service was unavailable for an extended period due to our fault
• You were charged incorrectly or duplicated
• You cancel within 7 days of your first subscription (first-time users only)

Refund requests must be submitted to billing@beast.com within 15 days of the charge. Refunds for annual plans will be prorated.

8. Intellectual Property

The Service, including its design, code, features, branding, logos, and documentation, is owned by BEAST and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

You retain ownership of all content you create and upload through the Service, including chatbot flows, message templates, and contact lists. By using the Service, you grant us a limited, non-exclusive license to process this content solely to provide the Service to you.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEAST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Termination

Either party may terminate this agreement at any time. You may cancel your account through your dashboard settings or by contacting our support team. We may suspend or terminate your account if:

• You breach any provision of these Terms
• You fail to pay applicable fees
• Your use of the Service poses a risk to other users or our infrastructure
• Required by law or regulatory authority

Upon termination, your right to use the Service will cease immediately. We may retain certain data as required by law or for legitimate business purposes.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
